These terms cover your use of Kai. By setting up an account you're agreeing to them.
What Kai does
Kai provides an automated assistant that answers calls to your business, books appointments in your diary, sends messages to your customers, and raises quotes and invoices on your behalf. It acts on the information you give it — your services, prices, availability and working hours.
Your account
You must be operating a genuine business in the United Kingdom and be at least 18. Keep your sign-in secure; you're responsible for what happens under your account. One account covers one business.
Paying
- The subscription is billed monthly in advance. The price is shown before you sign up.
- Calls answered beyond your monthly allowance are charged at the per-call rate shown at sign-up, billed in arrears.
- You can cancel at any time and it takes effect at the end of the month you've paid for. We don't refund part-months.
- If a payment fails we'll try again and let you know. If it stays unpaid we may suspend the assistant — your data stays put and comes back when you settle.
- We'll give you at least 30 days' notice in the app before any price change.
What the assistant can and can't do
Kai only quotes prices you have given it and only offers appointment times that are free in your diary. Where you've told it a job needs a proper look before you can price it, it says so rather than committing you to a figure.
That said, it is automated software and it can get things wrong. You remain responsible for the work you take on and the prices you honour. Check your diary and your quotes. If the assistant books something you can't do, cancel it in the app and it will let the customer know. We're not liable for the cost of a job you'd rather not have taken.
You can switch the assistant off at any moment.
Your customers
The customer details in your account belong to you. You're responsible for having a lawful basis to contact them and for telling them their calls may be recorded — the assistant does this at the start of each call on your behalf. You must not use Kai to send marketing to people who haven't agreed to it.
Fair use
Don't use Kai for anything unlawful, don't try to break it or get into other people's accounts, and don't resell it as your own service. We can suspend an account that's doing any of these.
Availability
We work to keep Kai running at all times but we can't promise it will never be unavailable — it depends on phone networks, payment providers and hosting we don't control. We'll give notice of planned maintenance where we can.
If things go wrong
Nothing in these terms limits our liability for death or personal injury caused by negligence, for fraud, or for anything else that can't be limited by law. Beyond that, our total liability to you in any 12-month period is limited to what you paid us in that period, and we're not liable for lost profits or lost business.
Kai is a business service, so the consumer rights that apply to personal purchases don't apply here.
Ending it
You can close your account in the app at any time. We can end this agreement with 30 days' notice, or immediately if you breach these terms. When your account closes you can export your data, and we delete it as described in our Privacy Notice.
Changes
If we change these terms we'll tell you in the app at least 30 days beforehand. Carrying on using Kai after that means you accept the new version.
Law
These terms are governed by the law of England and Wales, and the courts of England and Wales have exclusive jurisdiction.
